K\u00e4esolevas artiklis keskendume k\u00fcsimustele <strong>kes kohustub tasuma remondifondi eest ning kas tagatisraha v\u00f5ib k\u00fcsida rohkem, kui \u00fche kuu eest?<\/strong><\/p>\n<h2><strong>Kes maksab remondifondi eest?<\/strong><\/h2>\n<p>Uue seaduse raames eluruumi \u00fc\u00fcrilepingu puhul v\u00f5ivad pooled kokku leppida, et \u00fc\u00fcrnik maksab m\u00f5istlikus, proportsionaalses ja etten\u00e4htavas ulatuses terve hoone (nt kortermaja puhul kortermaja konstruktsioonide, tehnos\u00fcsteemide ja \u00fcldpindade) korrashoidmiseks ja parendamiseks vajalikke kulusid. M\u00f5istlik, vajalik ja etten\u00e4htav on nt olukord, kus \u00fc\u00fcrnik peab \u00fc\u00fcrilepingu t\u00e4itmise jooksul tasuma remondifondi umbes samas suurusj\u00e4rgus, kui oli \u00fc\u00fcrilepingu s\u00f5lmimise hetkel.<\/p>\n<p>\u00c4riruumi \u00fc\u00fcrilepingu puhul on pooled praktiliselt piiranguteta vabad valima, millistes tingimustes nad kokku lepivad. Kokkuleppe puudumisel maksab remondifondi \u00fc\u00fcrileandja.<\/p>\n<h2><strong>Kas \u00fc\u00fcrileandjal on v\u00f5imalik k\u00fcsida tagatisraha rohkem kui \u00fche kuu eest?<\/strong><\/h2>\n<p>Jah. Siinkohal tasub arvestada, et seaduse kohaselt v\u00f5ib eluruumi \u00fc\u00fcrilepinguga ette n\u00e4ha, et \u00fc\u00fcrnik maksab lepingust tulenevate n\u00f5uete tagamiseks \u00fc\u00fcrileandjale tagatisraha kuni kolme kuu \u00fc\u00fcri ulatuses. \u00dc\u00fcrnik v\u00f5ib tagatisraha maksta kolme kuu jooksul v\u00f5rdsetes osades. Esimene osa tuleb maksta p\u00e4rast \u00fc\u00fcrilepingu s\u00f5lmimist.<\/p>\n<p>\u00c4riruumi \u00fc\u00fcrilepingu puhul \u00fclal toodud piirangud ei kehti, ehk \u00e4riruumi tagatisraha v\u00f5ib olla ka suurem kui 3 kuu \u00fc\u00fcri ulatuses ja selle tasumine v\u00f5ib toimuda ka korraga.<br \/>\nKui eluruumi \u00fc\u00fcrileandja on tagatisraha arvelt rahuldanud oma n\u00f5ude \u00fc\u00fcrniku vastu, v\u00f5ib ta n\u00f5uda tagatisraha taastamist \u00fc\u00fcrilepingus kokkulepitud ulatuseni. \u00dc\u00fcrnik v\u00f5ib tagatisraha taastada kolme kuu jooksul v\u00f5rdsetes osades.<\/p>\n<p>\u00c4riruumi \u00fc\u00fcrilepingu puhul v\u00f5ib samuti n\u00f5uda tagatisraha taastamist kokkulepitud ulatuseni, kuid eluruumi \u00fc\u00fcrilepingu puhul kohalduvate piiranguteta.<\/p>\n<h2><strong>Taavo Annuse, Bidrento asutaja kommentaar tagatisraha k\u00fcsimusele:<\/strong><\/h2>\n<blockquote><p>\u201cKui \u00fc\u00fcrileandja on n\u00f5udnud \u00fc\u00fcrnikult tagatisraha, siis seaduse j\u00e4rgi peab ta selle hoiustama krediidiasutuses oma varast eraldi ning v\u00e4hemalt kohaliku keskmise intressiga. Kui vaadata n\u00e4iteks 12-kuulise t\u00e4htajalise hoiuse intresse viies suuremas Eestis tegutsevas pangas, siis need on hetkel vahemikus 0%-1,1%, mis lihtsa arvutuse kohaselt teeniks intresside n\u00e4ol 0-5,5 EURi aastas (arvestatud oli Tallinnas keskmise kuu \u00fc\u00fcriks 500 EURi, 1 kuu \u00fc\u00fcr tagatiseks ning kasutati 12-kuulist t\u00e4htajalist hoiust).
